Article IX, Section 1Architectural Control
Before anyone shall commence any landscaping or the construction
, reconstruction, remodeling, addition to, or alteration of any building, wall, fence, or any structure whatsoever, on any Lot or Common Areas there shall be submitted to the Architectural Control Committee (herein referred to as the “Committee”), one complete set of plans and specifications for said improvements the erection or alteration of which is desired. No such structure or improvements of any kind shall be erected, altered, placed or maintained upon any Lot unless and until the final plans; elevations and specifications therefore have received written approval as herein provided.

Architectural Control in Dutch Creek Village derives, primarily, from four articles in the Declaration of Covenants, Conditions, and Restrictions. This document can be found on the Governing Documents page. The Covenants Extract Document puts the architectural control provisions in a more convenient form.

Article X, Section 3 – Building Locations and Height Restrictions
No building, primary or accessory, shall be located on any Lot within the setbacks as follows:
Single Family

  • Front yard 20 feet
  • Side yard 15 feet total, 5 feet minimum
  • Rear yard 20 feet

The Architectural Control Committee shall approve the location and height of any structure placed on any Lot. Such approval must be obtained before commencement of any construction or alteration in accordance with Article IX.

Failure to obtain prior written approval is a “violation of the covenants” and subjects an owner to the penalties associated with such a violation. An owner contemplating alterations and improvements to his/her property should become completely familiar with all the architectural provisions of the declaration.
